There will be no speedy trial for the man alleged of murder in Waverly earlier this month.

Thirty-three year old Nathan Henson, of Waverly, will undergo examination of his physical and mental fitness after a motion was granted by Judge Chris Reif yesterday.

Public Defender Tom Piper, who is representing Henson in the case, made the motion yesterday for the examination. After meeting for a short time with Judge Reif, Morgan County State’s Attorney Gray Noll had no objection to the motion, saying Piper was in the best position to know if there could be doubt about Henson’s mental state.

Henson was arrested on September 5th near his home in the 300 block of Elm Street in Waverly, where authorities responded to a call regarding a woman in need of medical attention. That woman turned out to be Nathan Henson’s wife Jessie Henson, who was subsequently pronounced dead at Memorial Medical Center in Springfield after being hit with a bat and stabbed with a knife.

Henson is facing first degree murder charges and charges of intentional homicide of an unborn child.

By granting the motion, Judge Reif moved Henson’s scheduled court date of September 26th to October 27th.
