Small Claims Court suit filed against sheriff’s deputy

A deputy for the Morgan County Sheriff’s Office is named in a small claims lawsuit.

The plaintiffs are Joshua and Ann Madsen of the 300 block of Marnico Road in Jacksonville, who filed the suit last week in Morgan County Court against Tom Keegan both individually and in his capacity with the department.

Morgan County Sheriff Randy Duvendack says it has to do with a situation in September where Keegan was called to a repossession on the Madsen property. Duvendack says Madsen apparently tried to stop the process, leading to authorites being called.

No arrests were made, according to Duvendack, but the suit seeks $10,000 in damages for violation of constitutional rights and due process, unlawful detainment, emotional distress, loss of wages and pain and suffering.

Duvendack wouldn’t comment further on the lawsuit other than to say the sheriff’s department will defend it and deny the allegations.
